The Attorney-General's Department guidelines for marriage celebrants say a person divorced overseas should give the celebrant the divorce documents from the country that granted it, and that the celebrant should ask for an official NAATI certified translation of any document not in English. In some cases a court declaration under section 104 of the Family Law Act may be needed.

Married overseas?

To apply for a divorce in Australia after marrying overseas, the Federal Circuit and Family Court asks for a translated marriage certificate attached to an Affidavit of Translation of Marriage Certificate from the translator. Tell us in the comments if that is your purpose.

From the Department of Home Affairs' guidance on documents in languages other than English:

Is a NAATI translation required to marry again?

The celebrant guidelines say a celebrant should ask for an official NAATI certified translation of documents not in English. They also say the Marriage Regulations do not themselves require an accredited translator, except in one case involving minors. In practice, celebrants ask for it.

Is my overseas divorce recognised in Australia?

The celebrant guidelines note that the department cannot verify foreign divorce documents, and that a declaration under section 104 of the Family Law Act may sometimes be the only satisfactory evidence. If in doubt, seek legal advice.

How is a long decree priced?
