Probate in NSW

The Supreme Court of NSW probate checklist says that if the deceased died overseas, a certified translation of the death certificate is required, and a person who knew the deceased and saw the body must file an affidavit confirming the death. A will in a language other than English also needs a certified translation.

What Home Affairs asks of a translation

From the Department of Home Affairs' guidance on documents in languages other than English:

  • Provide the original document together with the English translation.
  • In Australia, use a translator accredited by NAATI.
  • Include the translator's full name, address and telephone number, and qualifications and experience in the language, all in English.
